Limitation of Use
You may not modify copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or sell any information images or products on this website, unless given prior written consent by Dignified Living Ltd to do so.
1. Parties
a. The company means Dignified Living Ltd.
b. The customer means the person, firm or company buying the goods from the company to whom the goods are to be invoiced (unless the context otherwise requires) and any person to whom or for the benefit of whom the goods may be delivered.
c. The goods means the exact goods described in our invoice.
2. Orders
a. UK orders will attract a minimum shipping cost of £3
b. The minimum order value for international customers is £200 excluding net of discounts and freight.
c. Taxes are included in the price of our products.
3. Quotations
Any estimate or quotation shall comprise an invitation and will remain open for a period of thirty days, provided that the customer has not withdrawn it.
4. Prices
All prices are inclusive of taxes and will incur extra and variable shipping charges depending on the method and choice of carriage chosen by the customer, for which the customer, person, company or firm will be liable.
5. Specification
Every effort is made to ensure that online description and illustrations are clear and accurate. All colours and sizes are approximate. The production of colour where indicated are as accurate as photographic processes allow The company Dignified Living Ltd reserves the right to amend the specification, construction and or design without prior notice.
6. Payment Terms
Unless the company otherwise agrees, Dignified Living Ltd requires 50% of the total cost of goods on placing the order and 50% on delivery; or within 30 days of the invoice date. We will accept payment by cash, cheque and debit or credit card.
7. Interest and Overdue invoices
All overdue invoices for money owed to Dignified Living Ltd will be subjected to a rate of 3.5% interest per month from the final due date of payment.
8. Warranties and Guarantees
Unless otherwise stated, a twelve month guarantee applies to all products with the exception of disposable and limited life products. The company warranties that the goods shall at the time of delivery correspond to the specification published by the company when used for the purposes for which goods of that type are ordinarily used. Dignified Living Ltd warrants that the goods shall at the time of delivery be of merchantable quality. If any goods do not conform to that warranty, the company will at its option:
1. Replace the goods found not to conform to the warranty
2. Bring goods into conformity with the published specifications of the company or (as the case may be ) merchantable quality; or
3. Take back the goods found not to conform to the warranty and refund the appropriate part of the purchase price. This does not affect your statutory rights.
9. Delivery
a. Unless the company otherwise agrees, delivery shall be made to the delivery point specified in the order.
b. Stated delivery times are no more than an estimate on the part of the company an shall not be binding upon the company, which shall not be liable for any costs or damage caused by any delay in delivery.
c. The company reserves the right to charge interest on all overdue payments and outstanding balances at the rate of 3.5 % per month.
10. Risk and Ownership (Title)
All risk in the goods shall pass to the buyer (person, company, organization or firm) upon delivery
11. Intellectual Property
All Copyright shall remain the property of Dignified Living Ltd alone unless otherwise expressly agreed in writing with the customer. Dignified Living limited owns the patent and design rights where indicated, to all goods supplied by us. We reserve the right to take legal action against any party, person, firm or company whom we believe are infringing our intellectual property rights Dignified Living Ltd is a member of ACID
12. Cancellations and Returns
Cancellations and returns must be the exact and identical item purchased from Dignified Living Ltd. The customer is responsible for all shipping and handling cost which may be incurred in transporting the goods to Dignified Living Registered office.
13. Waiver
The failure of either party to enforce at any time or from any period any one or more of the Terms and Conditions herein, shall waiver of them or of the right at any time subsequently to enforce all terms and on one occasion, this does not mean that is a waiver of our rights to enforce the Terms and Conditions of this agreement.
14. Liability
The entire liability of the supplier to the buyer/customer (person, company, organization or firm) in respect of any claim whatsoever or breach of this agreement, whether or not arising out of negligence, shall be limited to the price paid by the customer to which the claim relates.
Indemnification
The customer shall indemnify the supplier against all claims, costs and expenses which the supplier may incur and which arise directly or indirectly, from the customers breach of any of its obligations under this agreement, including any claims brought against the supplier alleging that the goods and /or services provided by the supplier in accordance with the specification
15. Force Majeure
Dignified Living Ltd shall not be liable for any delay or failure to perform any of its obligations if the delay results from events or circumstances outside its reasonable control, including but not limited to acts of god, strikes, lock outs, accidents, war, fire, act of omission of government, highway authorities or any telecommunication carrier operator or administration or other competent authority or the delay or failure in manufacture, production, or supply by third parties of equipment or services; and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.
16. Complaints
This sets out the complaints procedure: All complaints arising by customer/buyer (person, company, organization or firm) must be made in writing and send to the registered address of Dignified Living ltd unless otherwise indicated. All complaints will be dealt with in a fair and confidential manner in order to show good business relations with (person, company, organization or firm).
17. Jurisdiction
This agreement shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts
